Getting Divorced
An uncontested divorce is without a doubt the least expensive route to take. You and your spouse will work together to agree on the terms of your divorce. Both parties agree on how to divide assets and, if there are children, which parent will become the parent of primary residence and which will be the parent of alternate residence. We draft a settlement agreement, as well as a parenting plan (if there are children involved). There is no formal trial, and only the plaintiff has to appear in court.
Parental Rights
There are many ways for parents to acquire parental responsibilities and rights, all regulated by the Children’s Act. Biological parents acquire these rights automatically, but different rules apply for biological mothers, married fathers and unmarried fathers. The Act also automatically assigns parental responsibilities and rights in respect of children conceived by way of artificial insemination.
Paternity Disputes
With maintenance disputes, a court must determine whether a person is indeed liable to pay maintenance. Maintenance claims are based on paternity, liability needs to be established first. The maintenance court has the jurisdiction to determine maternity and paternity.
Parenting Plans
When parents experience difficulties in exercising their responsibilities and rights, they must agree on a parenting plan, before approaching the court. We advise first seeking the assistance of a family advocate, social worker or psychologist. Alternatively, mediation facilitated with the help of a social worker or qualified professional.
